Canadian visa refusal

Reconsideration, appeal to the Immigration Appeal Division or judicial review in the Federal Court. The deadlines are short.

Appeals Short deadlines Officer’s notes IRCC, IAD or Federal Court

Several grounds can lead to a refusal of entry or of stay: security, violation of human or international rights, criminality even when minor, organized criminality, health grounds, financial reasons, misrepresentation of any kind, non-compliance with the Immigration and Refugee Protection Act. The mere fact that a member of your family is inadmissible can be enough.

The avenues of recourse

Request for reconsideration with IRCC - the fastest, useful when a document was misread or overlooked.

Appeal to the Immigration Appeal Division - open only to certain categories of applicants.

Judicial review in Federal Court - where the decision is tainted by an error of law or a breach of procedural fairness.

Time is working against you

Each avenue has its own deadline, counted in days from the notification. Which one suits you depends on the type of application, your status in Canada and your personal situation. The burden will be on you to show why the application should not have been refused.

How we help

We request the officer notes from the Global Case Management System, we read the real reason behind the form letter, then we tell you frankly whether a recourse or a fresh application stands a chance. A temporary resident permit is sometimes the right answer to inadmissibility.
